Terms & Conditions

These Terms and Conditions (“Terms”) govern access to and use of the Infonetix ESS & Attendance mobile application (“the App”), operated by Infonetix payroll solutions(“we”, “us”, or “our”).
By accessing or using the App, you agree to these Terms.
1. Purpose of the App
The App provides employee self-service and workforce management functionality to participating organisations and their authorised users.
Depending on the services enabled by an organisation, functionality may include:

Employee attendance recording;
-
Clock-in and clock-out functionality;
-
Break recording;
-
Leave applications and leave management;
-
Payslip and employee-document access;
-
Employee profile information;
-
Workplace notifications; and
-
Other employee self-service or workforce management features.
Features available to individual users may vary according to the organisation’s subscription, configuration, permissions and user role.
2. User Accounts
Access to the App may require an authorised account associated with a participating organisation.
Users are responsible for:

Keeping their login credentials confidential;
-
Not allowing unauthorised persons to use their account;
-
Providing accurate information when using the App;
-
Promptly reporting suspected unauthorised access; and
-
Using the App only for legitimate workplace purposes.
Users must not attempt to access another user’s account or information without authorisation.
3. Attendance Records
Where attendance functionality is used, users are responsible for ensuring that attendance actions they submit are accurate and relate to themselves unless they are specifically authorised to perform an action on behalf of another person.
Users must not intentionally falsify attendance information, manipulate attendance records or attempt to bypass attendance controls.
The App provides technology for recording and displaying attendance information. The relevant employer or organisation remains responsible for its employment policies, working-time rules, payroll decisions and interpretation of attendance records.
4. Leave Requests
The App may allow employees to submit leave applications and supporting information.
Submitting a leave application through the App does not automatically mean that leave has been approved.
Approval or rejection remains subject to the policies and decisions of the relevant employer or authorised manager.
We are not responsible for employment decisions made by an employer using information available through the App.
5. Payslips and Employment Documents
Documents displayed through the App may be provided or uploaded by the user’s employer or authorised representatives.
The employer remains responsible for the accuracy and completeness of employment, payroll and related documentation it provides through the service.
Users should report discrepancies directly to their employer or appropriate administrator.
6. Acceptable Use
Users must not:

Use the App for unlawful purposes;

Attempt to gain unauthorised access to systems, accounts or information;
-
Submit deliberately false attendance or employment information;
-
Interfere with or disrupt the App or its infrastructure;
-
Attempt to circumvent security or authentication controls;
-
Introduce malicious software or harmful code;
-
Reverse engineer or attempt to exploit the App except where permitted by applicable law;
-
Use another person’s credentials without authorisation; or
-
Use the App in a manner that infringes the rights of another person or organisation.
Access may be suspended or terminated where misuse, unauthorised access or other violations are reasonably suspected.
7. Employer Responsibilities
Organisations using the App are responsible for:

Ensuring that their use of employee information complies with applicable law;

Providing accurate employee and organisational information;
-
Assigning appropriate user permissions;
-
Managing authorised users;
-
Establishing their own employment, attendance and leave policies; and
-
Informing employees about relevant workplace policies and data-processing practices where required.
The App does not replace an employer’s legal or regulatory responsibilities.
8. Availability of the Service
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.
The App may occasionally be unavailable due to maintenance, upgrades, internet connectivity, third-party infrastructure failures or circumstances outside our reasonable control.
Where practical, we will take reasonable steps to restore affected services.
9. Internet and Device Requirements
Certain features require internet connectivity and a compatible mobile device.
Users are responsible for their own device, internet connection and any charges imposed by their network provider.
We cannot guarantee compatibility with every device, Android version or third-party configuration.
10. Intellectual Property
The App, including its software, design, branding and original content, is owned by or licensed to Infonetix payroll solutions, except where otherwise indicated.
Users are granted a limited right to use the App for its intended purpose while authorised to access the service.
Nothing in these Terms transfers ownership of the App or its intellectual property to the user.
11. Privacy
Personal information processed through the App is handled in accordance with our Privacy Policy and applicable privacy and data-protection requirements.
The Privacy Policy should be read together with these Terms.
12. Limitation of Liability
To the extent permitted by applicable law, we will not be liable for indirect, incidental or consequential losses arising from use of or inability to use the App.
The App is a technology platform and does not make employment decisions on behalf of participating organisations.
Employers remain responsible for decisions relating to employment, leave, attendance, payroll, disciplinary matters and other workplace matters.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
13. Suspension and Termination
Access may be suspended or terminated where:

A user’s employment or organisational access ends;

The relevant organisation disables the account;
-
The organisation’s access to the service ends;
-
The user breaches these Terms;
-
Fraudulent, abusive or unauthorised activity is suspected; or
-
Suspension is reasonably necessary to protect the security or integrity of the service.
14. Changes to the App or These Terms
We may modify the App, introduce new functionality, discontinue functionality or update these Terms from time to time.
Where appropriate, material changes will be communicated through the App or other reasonable means.
Continued use of the App after updated Terms take effect constitutes acceptance of the revised Terms where permitted by applicable law.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory rights or protections available under applicable law.
